DNA evidence proves that the Ashera is a Savannah cat

Finally, the news we were waiting for. We knew the result, we just wanted it officially confirmed. The three Ashera kittens confiscated at Schiphol Airport months ago are F1 Savannahs bred by Chris Shirk of Cutting Edge Savannahs. His post today to the Savannah cat community:

I have received official word today that it has been confirmed all three Savannah kittens confiscated in the Netherlands are from my cattery!!!
The court is still proceeding and the decision has not yet been made as to where the kittens will go. I have requested their return but it's up to the judge. However, their forensic labs have all confirmed they are from parent cats owned by me, Christopher Shirk of Cutting Edge Cats. They are Savannahs produced by my cats, not Ashera cats from Simon Brodie's scamming Life Style Pets business.
I guess Simon Brodie, if you're reading this, you'll do what you do best....disappear. ...But you will face the consequences of what you did to my kittens. CHRIS

The fun has only begun... looks like you defrauded someone out of lots of money and made statements that the kittens had bloodlines they didn't. I suggest you are the one that dissapears (at least, before Fish and Wildlife come round). Oh, and by the way, once you take CASH for your cats - which you were so desperate to sell, at any price - they are no longer yours... P.S. Our attorneys are on their way to you... enjoy!!!

And by the way - we are selling around 10 ASHERAS a month (two sold today alone) - many to people who have bought Savannah kittens on great promises and then had to return them because of all sorts of problems. I will be posting their comments, and the Savannah catteries from where they bought them, very shortly. I guess only bad Savannah breeders need to be concerned, because the good ones are the ones behind what I am doing. (which makes them the intelligent Savannah breeders...) Everyone, I am NOT going away, so live with it. And if you want me to refer people who don’t have the money for an Ashera, but can afford a good Savannah, my door is open.

OH PLEASE. Chris never defrauded anyone. You, Mr. Simon Brodie, are the one defrauding people. Just like you did with the hot air balloon business. Your a crook and thats all there is to it. Take your threts eslewhere. We are not afraid of a loser like you.

Oh, but you see, Chris did. And by the way, how about you reveal your true name? Or is it that you might be one of the Savannah breeders I have on my list? I guess we'll all find out when I publish it next week... and by the way, sold two more Asheras today (that's 4 in two days)... busines is good, thanks to all those bad Savannah breeders, whom I would like to thank for all the publicity... gives me lots to talk about with prospective clients curious why all the negative towards the company, and has really helped close each sale. Please keep it up!

This is a polite notice that the term ASHERA is trademarked and the owner has the right to claim monetary damages from anyone using on their website without permission. We will be inspecting every Savannah breeder's website for infringement in the next 7 days, will make copies of those web pages and WILL take action against unauthorized use.

It is perfectly legal to use the name Ashera on a website, regardless of whether it is copyrighted. You can also use the words Beatles, Microsoft, Pepsi, etc....

When I read claims that Savannahs are being returned by people who now are buying Asheras, I really have to laugh.

It is now proven that Savannahs were sold as Asheras by Lifestyle Pets. I look forward to being entertained by Simon Brodie's explanation.

Brigitte said...

How about naming some of those "good" breeders that are supposedly supportive of your business, "lifestyle pets"? Now THAT would be an interesting list!

GiveMeABreak said...

Simone,

Your threats are idol. Its been proven now that you ARE not the breeder of Ashera Cats. You underhandedly buy SAvannahs cats and put a new breed label on them. You do nothing but lie and threaten. You have no way to back up a law suit.

Chris has NOT defrauded anyone. How do you figure. You bought the cats from someone he sold them too. There IS DNA proof that you are NOT the breeder and that Chris is. I am going to throw a big party the day your tossed in the slammer for a few years for ripping people off. Why can't you just start and ethical business. Why must you always have to scam people. Its makes you look very pathetic.

GiveMeABreak said...

HAHAHAHAHAHA. You can take your polite notice and stick where the sun doesn't shine. We are allowed to use the name as we feel as long as we don't sell anything under that name. Believe me, that won't happen as we are honest people, unlike you. Here is a sentance that you can't touch:

It is my opinion that Simone Brodie of Lifestyle pets is a dishonest man selling cats labeled as Ashera's, but are really Savannah cats that he has had his underhanded flunky's buy under an assumed name.

And its a perfectly legal statement to make with you having any claim to retribution. AAAAHHH, Life is good.

P.S. I will give you my real name is you provide a REAL list of people you are buying the Savannahs from.

Lifestyle Pets said...

Really people, you are pathetic. No wonder we get some many clients who come us after dealing with the majority of Savannah breeders. Which is why effective the 15th of this month, LIFESTYLE PETS is also selling Savannahs in addition to Asheras. You asked for it, and you got it.

Brigitte said...

Yeah, also selling Savannahs is REALLY going to prove you are legit... giggle!

Okay, I do not think the person posting as Lifestyle Pets is really Lifestyle Pets. If it is I find it very odd they are selling Savannahs too. The Ashera though its Serval lineage is a Savannah. I am simply confused now. KRISTINE C. ALESSIO, ESQ.

EMILY said...

I am unsure that the person posting as Lifestyle Pets
is really a bonafide representative of Lifestyle Pets? Per TICA's rules on the Savannah, the Ashera is a Savannah anyways owing to its Serval lineage. If you are really Lifestyle Pets contact me off the blog at KCKCSASA@COX.NET. KRISTINE C. ALESSIO, ESQ.

GiveMeABreak said...

HAHAHAH, You did not sell 4 Ashera's ( really savannahs ) in 2 days. You lie a lot. Its obvious that Chris knew you were getting those Savannahs through A1. Now he has turned on you and you dont like it, do you. All, I can say Mr. Brodie is Touche' to Chris for playing you.

Brigitte said...

"If you can't beat 'em, join 'em" comes to mind... can't sell Asheras without them being DNA tested and proved to be Savannahs, so change the business plan and start selling Savannahs!

Not a problem to me, there's always a market for hyped-up, over-priced goods. People buy from a small home-based cattery like mine for a reason, and no amount of slick marketing is going to change that.

I'm happy if this means that the cats will be sold as what they REALLY are. And hopefully any breeder willing to sell their kittens to be resold with the Lifestyle Pets "brand name" is doing it knowingly and not via some subterfuge of a third party.

GiveMeABreak said...

Exactly my thoughts. There are most likely many Savannah breeders that would sell to Brodie if he approached them honestly. Sadly, that is not in his genetic makeup.

Стивен said...

Wow. Break out the popcorn. lifestyle pets says they're making a lot of money selling "Asheras," but it looks like all this money will end up in the pockets of many attorneys. Have a look at the blog post Quack of the week: Simon Brodie for some background on the "Allerca" cat. This Wikipedia article may also be relevant for some insight into these events. Make sure you get excellent attorney recommendations.

Chris Shirk said...

Well Brodie, It's been two months since I outed you as the scammer that you are. You have threatened me with your attorneys...Where are they??
Also, I have cooperated fully with The United States and Netherlands government, and through a forensic lab proved the DNA of those kittens were bred by my cattery. What have you done to prove your claim they are Ashera cats? Really Brodie, do not threaten or bad mouth me, it only makes you look more stupid. Chris

Serial scam artist Brodie has already changed name and location. See http://newcarradanski.com/: I apologise for length of this comment, but feel free to republish it on other blogs in its entirety as it has a timeline of his companies.

Convicted Con-Artist has New Name and New Venture

Serial con-artist and convicted fraudster Simon Brodie has a new name and a new venture. As Simon Carradan he offers exclusive US$19,000 skis and used Reuters to promote this latest "pay 6 months in advance and cross your fingers it's for real" scheme. Carradan Skis has no store and operates from the same office as Flexpetz (now headed by his partner Maria Cervantes) and several other Brodie ventures. An illusion of plausibility is provided by trademark applications and a slick-looking website - but how real is it? It seems the USA lacks a joined-up legal system able to stop con-artists moving from state to state taking deposits, failing to deliver product and then with a trail of unpaid debts.

The change of name and location comes just a few months after publicity about 3 of his Lifestyle Pets Ashera cats that were seized in continental Europe. The cats were being investigated after a US Savannah breeder identified them as Savannah cats he had bred and sold - adding weight to claims and suspicions that the over-priced, over-hyped Asheras were Savannahs. DNA proved the 3 cats were F1 Savannahs fraudulently resold by Brodie's company.

More on Carradan Skis here, here and here

Brodie's previous smoke-and-mirrors ventures left behind debts, court judgments, liens, and unpaid employees, according to court records and statements from former associates and victims, while Brodie enjoyed the high life. He claims to have created and sold several successful private companies and start-ups, blaming failures on lack of investor funding and activities of rival companies. Many involve exploiting the franchise scheme: taking money up-front for a hyped product and letting franchise-buyers bear the loss.

1994, England: Brodie was convicted of 7 counts of false accounting. He was given a 2.5 years jail sentence for his part in Cloudhoppers, a failed hot air balloon-flight business in East Sussex. It offered franchises for UK200,000 each and collapsed in 1992 leaving people out of pocket and owing UK£214,000 to banks. He claimed in 1992 news reports (The Argus) to have grossed UK£1 million in the first year with ambitions to expand to a UK£50 million concern in the USA. He attempted to sell Cloudhoppers for UK£4 million, claiming to be the largest ballooning company in the world. Cloudhoppers had only 2 balloons and continued to take bookings for expensive balloon flights even after the Civil Aviation Authority revoked its licence to fly. After serving less than 1 year in jail, he left Britain and went to the USA where court records show a string of financial offences and unpaid debts.
1999, Delaware, USA. Brodie founded Cerentis LLC. One of Cerentis' products was software training packages. Customers bought a US$50,000 package and expected to be employed after training. According The Boston Globe (July 2007), one British customer was trained at California-based Alphalogix in 1999, but Brodie vanished before the 3 week course was completed and the promised job did not materialise. Computer Weekly and found Integra clients struggling to pay off huge debts for the exorbitant course fees. LA County court records show Alphalogix were owed US$30,600 by Brodie who denies having ever heard of Alphalogix.
September 1999, New York. Cerentis proposes to use the web to create “the world's most powerful computer processor.” Set-up in the same way as the nonprofit SETI At Home project, Cerentis' Terra One venture would process data for clients, but would charge for the service. The Cerentis news release stated “in association with the biggest and best online retailers,” such as Amazon.com and Dell, in which users would build up credits that could be used to make purchases at online stores. Amazon.com and Dell have never had any association with either Cerentis or Brodie. Cerentis' mailing address was Brodie's New York home address. Cerentis owes more than US$50,000 in state taxes and has numerous liens against it.
1999: Brodie and 2 Brodie-affiliated companies, Cerentis and Integra Associates, defaulted on a US$72,280 promissory note.
October 2004: Allerca set up in California and announces plans to genetically engineer allergen-free cats. It takes deposits to reserve cats in advance of their creation.
December 2004: Colorado-based Transgenic Pets LLC sue Allerca and Brodie for allegedly stealing trade secrets and business plans. Brodie, representing Florida-based Geneticas Life Sciences, had posed as a potential investor in Transgenic Pets. He signed a nondisclosure agreement in order to view confidential information. In Sept 2004 he had signed articles of incorporation to create Allerca, with Transgenic founder David Avner as its president and agreed to invest US$2.5 million in the new company, but in October he told Avner he and Geneticas would not participate. Instead, he incorporated Allerca in California and issued a press release about hypoallergenic cats. Company denies they are the naturally low-allergen (and much less expensive) Siberian breed of cat. Allerca's work is never peer-reviewed.
2005: Brodie's Los Angeles landlords win a judgment against Brodie for failure to pay his rent. Brodie tries to raise US$500,000 to fund a San Diego animal diagnostics company, GeneSentinel (owned by Allerca), of which he was chairman, president and CEO although the company assets were only US$3,000 and its debts were $200,000! GeneSentinel plans create tests to screen animal samples for genetic mutations. They have extensive discussions with Minneapolis-based Fair Isaac Corp regarding the development of a similar product using Fair Isaac technology. Negotiations break off in June 2005. Fair Isaac inform Allerca that any attempt to move ahead with an alternative technology would result in legal action if Fair Isaac believes Allerca is using or disclosing Fair Isaac's confidential information. Gene Sentinel becomes Cyntegra.
January 2006: Brodie and Allerca were sued for defaulting on a US$25,000 loan.
February 2006: Allerca was evicted from its San Diego HQ, which was also Brodie's home, for failing to pay the rent.
March 2006: Novartis Animal Health, makers of Sentinel pet medicines, sues GeneSentinel, Allerca and Brodie, for infringement of Novartis' Sentinel trademark and cyberpiracy. Brodie sells his stake in Allerca to an unidentified investment group, but remains a consultant. Allerca's hypo-allergenic claims still not independently verified!
April 2006: Novartis is granted a permanent injunction against Brodie and his companies. Around the same time, GeneSentinel lays off several employees, who are owed thousands of dollars in unpaid wages, and becomes Cyntegra. Cyntegra, with Brodie as CEO, becomes embroiled in legal action against IDEXX Laboratories over diagnostics for early detection of bird flu.
November 2006: California's Department of Corporations orders Brodie and Allerca to "desist and refrain" from offering or selling franchises until they are registered with the state.
February 2007: Brodie has a US$285,000 federal tax lien placed against him by the Internal Revenue Service.
August 2007: Itchmo revealed that Brodie is the CEO of a company that owns pet-timeshare service Flexpetz. Brodie was CEO of Tetros Inc, which was purchased by ColdStar Capital in April 2007. A few days later, Flexpetz issued a press release describing itself as a wholly owned subsidiary of Tetros, who are both owned by ColdStar Capital. ColdStar is based out of the Cayman Islands. Brodie denied having any knowledge about ColdStar Capital, but retracted his denial when confronted with the SEC filing that listed him as CEO of Tetros Inc.
February 2008: 3 Ashera cats shipped to The Netherlands seized by officials under CITES legislation. Cats believed to be Savannahs purchased by Brodie or his associates from a US Savannah breeder and sold for many times their purcahse price as Asheras.
June 2008: Brodie adopts the name Simon Carradan and turns up in Big Sky, Montana; sets up Carradan Skis claims to produce a unique brand of ski designed and crafted using a proprietary blend of materials never before seen in a ski. Deposits are taken from customers 6 months in advance, actual product appears non-existent. Brodie claimed the name change was to protect himself from radical elements opposed to Ashera/Allerca/FlexPetz. Carradan skis uses same mailing address as the parent or holding company listed in the SEC records for Asensia, Tetros, Coldstar Capital, FlexPets (all Brodie companies). His partner and front-woman in both ventures is Marlena Cervantes. As with previous ventures, the address is just a mailing office and there is no actual street presence.

Brodie frequently denies involvement with companies and schemes in spite of listings and court records that link him with those companies. Brodie/Carradan has filed applications with The US Trademark Office to obtain copyrights to the names of the products he will allegedly sell through Carradan Ski. This merely makes the business look legit. According to trademark application rules, each application must go through a publication process in The Trademark Official Gazette for 30 days to allow the public/other companies to file an opposition to the trademark application. Brodie/Carradan's trademark applications are scheduled for publication in The Official Gazette August 26th, 2008, thus starting the 30 day period for oppositions to be filed. If enough people file oppositions to his applications, supported by details of his past business dealings, frauds and convictions (all on public record in the USA), the trademark office may reject his applications.
Opposition to trademarks can be filed electronically The file numbers of his trademark applications are 77415550, 77415523, 77408024, 77408007 & 77415525.

Hi All -

Forgive my ignorance, but I'm new to this blog & a little overwhelmed by all of this. I was originally drawn to Lifestyle Pets site because of their claims that their pets would not cause allergic reactions, but I've since learned of Simon Brodie's reputation & have decided not to purchase from them.

If they are actually just re-selling Savannah cats, does this mean that Savannahs are inherently less likely to cause allergic & asthmatic reactions?

Chris Shirk said...

Yes, the Savannahs are naturally hypo-allergenic. There is no smoke and mirrors and all the hyped up science to achieving that feature in a cat Simon Brodie is claiming. The Savannah cat comes from African Serval heritage. This wild cat has a course to velvet pelt (coat) that has very little shed and allergen factor. This carries through to the offspring even when the mother is a domestic cat. I sell many of my cats to asthma and allergy sufferers with great success. You may contact me as I am the one whose kittens are in the Netherlands. Chris www.cuttingedgecats.com

Watch out for this guy Chris - some facts:

He sold cats (in desperation I might add), took money, but now makes claim after claim that they are his. In my book, once you accept money for something it is no longer yours? So if you do buy from this guy, make sure it is done using a credit card so you have some financial recourse. Secondly, his claims that his cats are hypoallergenic, because of pelt size, etc, are utterly bogus - you WILL react and possibly affect your health ( not something he seems to care about). Lifestyle Pets has over 300 happy clients, but this is your choice. And again, if you decide to buy from him make sure that you get a full twelve month money back guarantee that covers everything, including accidental death - and not the standard 72 hour guarantee (he has one of the worse health reputation sin the cat breeding business as far as health goes), that he sends you a kitten already spayed or neutered, micro chipped, fully vaccinated and PCR tested for FIP - and that you get something in writing from him that he will take the kitten back if you react 9without a timeframe as it can take weeks for you to react). Or better yet, buy for a reputable Savannah breeder.

On a different note, you seem to have been swayed away from Lifestyle Pets by people like Shirk who put up negative information purely for their financial advantage (has anyone noticed this?). And no reputable savannah breeder would EVER claim their kittens are hypoallergenic and risk a serious, life threatening reaction of their client.

Then we have llewtrah (yes, we know who you are) who feels she can post anything without verification - can you verify all of this info you posted on Simon Brodie with real facts – of course not – so onetwoOHmygod , in the end, your choice – just go with a quality breeder, not this guy – we will be happy to point you in the direction of quality Savannah breeders. And if you are really allergic, but don’t feel you want to do business with Lifestyle Pets, then don’t get a cat.

Let me remind you Brodie, you are posting comments in a blog under the headline "DNA evidence proves that the Ashera is a Savannah cat". You really think you have any power of influence here?
So let me get this straight, You say I am careless with peoples' health by claiming my cats are hypo-allergenic. Yet, you sold MY CATS as Asheras with the same hypo-allergenic claim. Don't you think this makes you look at least slightly stupid for trying to bad mouth me? I have sold plenty of cats to people with allergies and asthma with great success. And I did this by breeding my cats, not by a fraudulent claim, like yourself, that you developed this hypo-allergenic factor in a lab.
On another note, just because I sold these kittens and you claim they are technically not mine, that doesn't remove the fact that due to my efforts and by my cats DNA EVIDENCE PROVES THAT THE ASHERA IS A SAVANNAH CAT.
One positive thing that came out of the media explosion uncovering you as a fraud...I have been able to advertise my Savannahs for the same price as Asheras. People would rather pay the higher prices for a cat with a pedigree. Plus, other than my three Savannahs you sold as Asheras, my cats have much greater quality than any cat you ever sold and the public is starting to take notice. I continuously get compliments on the striking contrast, color and size my cats have verses the Ashera, plus they like getting a pedigree with each kitten they buy. Business keeps getting better with this media buzz, and every comment you post here brings in another customer to me. Keep up the good work. Chris

Also, I want to say HAPPY BIRTHDAY to my Savannah boys over in the Netherlands. These poor guys were sold as something they weren't by Simon Brodie. They are one year old today. Born out of my domestic egyptian mau 'Jazz' and my African Serval cat 'Ace Man of Cutting Edge Cats'.
Had they been sold as Savannah cats (which they truly are) and not as Ashera cats without proper documentation, they would be in cozy homes with their owners instead of in quarantine involved in a legal custody battle. We all know who we have to blame for that, that's right: Simon Brodie of Life Style Pets. Chris

Brigitte said...

For "onetwoohmygod",
No, I would not guarantee my Savannahs as being "hypoallergenic". I am allergic to cats though, and I DO find them less allergenic and easier to tolerate. But I still take medication, have removed the carpets from my house and use air purifiers to reduce allergen load. They shed a lot less than domestic cats I have had previously, and they tolerate bathing easier so you can bathe them regularly to reduce allergenicity also.

I'm always suspicious of anyone claiming their cats are hypoallergenic, usually you would want to read the fine print and what the "guarantee" really means.

Ripped Off said...

Lifestyle Pets claims to have "sold" all kinds of cats, but all they are doing is taking people's money and not delivering any cats. Simon Brodie has my $$$ for a hypoallergenic cat that I will never see. There are websites like this one that are full of people that have sent him money up front for a cat, and as of yet, I've only heard of one person that actually got a cat, which was sick. They don't provide the upfront allergy tests, and as stated on their website "If we wish to cancel before our kitten is delivered, what is the refund policy?

Upon receipt of your payment, all sales are final. Please refer to the purchase agreement on our website for further detailed information.

However, we appreciate that personal circumstances can change from the time of order to the time of delivery that may make it impossible for a customer to take delivery. In these circumstances, we are prepared to offer a refund based on the condition that when we contact you ready to deliver the kitten and you advise that you are unable to take delivery, we will then allocate to a waiting customer and then arrange for your refund. please note that we cannot process a refund until such time as we are ready to deliver the kitten to a waiting customer."

Of course they will never contact you, saying that your kitten is ready, so you will never get a refund.

Also, why is the "purchasing" option disabled on their website?
Because it's a scam and it's catching up with you Simon.

With over 300 kittens delivered, I am surprised that you would even make this type of comment, given the potential legal repercussions - please provide your name and don't post anonymously - this way we can see who you are and take action accordingly, or we can post up all the details regarding your transaction with us.

Ripped Off said...

Yea right, 300 people that have been scammed is more like it. Why don't you publish these satisfied customers names and phone numbers that have kittens delivered on your website? Give legitimate references, not just some made up ones. Speaking of potential legal repercussions, you should be an expert in this area by now....what state have you moved on to now....what new scam have you got going....oh the snow skis....what new name are you going by these days....oh Simon Carradan. Don't worry Simon (whatever your name is this week), there are going to be a lot of happy people when your scams catch up with you.

llewtrah said...

He's in Big Sky, Montana using the name Simon Cadarran and the latest scheme/scam is paying now for skis that have to be "made to order". There is now a USA-wide watch on his activities. Unfortunately with 50 US states, that's 50 potential scams before running out of territory.

Well, now that we've all gone through this argument and are thoroughly pulling our hair out, I suggest one thing we all can do.

Adopt from a local shelter. Only a couple hundred dollars. Fixed, vaccinated, and ready for a loving home. And occasionally you will find a little pearl with pedigree papers! of course, it'd be maybe a hundred more, but that's what you guys are looking for, right?

Unknown said...

That's ridiculous! Yeah, just go down to your shelter and you will find an F1 or F2 Savannah...I'm all for adopting a kitty from a shelter but they are simply not going to be the same cat as a Savannah. Speaking as one of the Rescue Coordinators for Savannah Rescue we get very few of them into Rescue even now when the Breed is in the thousands, and even rarer is for one to be found in a shelter. So good luck with that thought!

Bill said...

I'm sorry to be interrupting your arguments. But I just heard of this cat, and through common sense as a normal person, I can say that this Simon Brodie is a cheap "breeder". Who has been marketing Savannah cats as his Ashera Cats. You can't run away from what you have done, and changing your name to Simon Cadarran won't give you a new leaf in your business. It just shows how despicable you are as a breeder and a businessman.
